Among the issues that have become a tangible reality that people deal with during the night and at the ends of the day are the means that resulted in human thought in our present era to facilitate communication between parts of the globe, so the distances were shortened and the barriers of time and space were overcome, and made the far near, and among these means is an electronic commerce and electronic arbitration, and dealing has spread It is used in the conclusion of commercial contracts in general, and in that it facilitates the human being and saves a lot of effort and time.
The emergence of the era of globalization and the electronic revolution in the world had an impact on changing many traditional concepts in our daily life matters, especially cultural and scientific. Rather, this revolution began to impose itself as a new engine for economic development, and communications shifted from telex, fax, and telephone to the Internet, and I would not be exaggerating if I said that it has become the means first in communication and information transfer, so the geographical borders between countries were removed, and time changed towards the amazing shortening of time until the world became, as it is said, just a small electronic village.
And with the development of matters for electronic commerce, in which commercial operations are carried out in simple seconds across countries and with modern means of communication, on top of which is the Internet, these transactions have become continuously growing, and electronic contracts that take place between individuals from different countries have appeared, and to complete this wonderful system, the electronic signature appeared to prove these contracts.
And here a new problem arose when a dispute arises over these electronic contracts because these contracts are made between individuals from different countries, and here arises the problem of conflict of international jurisdiction and conflict of laws and how to define fixed standards for such types of cases due to the lack of jurisdiction of national courts regarding claims arising from electronic transactions.
It is natural that such contracts, which are concluded at such a tremendous speed, cannot be doomed when any dispute arises to resort to the slow national courts that are burdened with supporting structures such as clerks, secretaries, memorization, execution, etc. from these flabby and outdated devices in addition to what is distinguished by these The last category of deviations known far and near, all of this made electronic arbitration is the best way, but I say that it has become the only way to resolve these disputes.
