As an avid law reader and professional, reading the Code of Hammurabi (c. 1700 B.C.E.), which declared “death” for most of the misdeeds. If they knew the prospects, they could accelerate their trade potential beyond expectation. Well, I realize the fact that contemporarily the criminal and administrative laws are also the picture of “justice delayed, justice denied.” Adjudication is yet needed to be instilled in our society to get its greater dividends for social justice and welfare. This realization inspired me to extend a “hands-on” legal research and write this book about adjudication.
This book has been compiled to serve the purpose of legal education. However, this process was both frustrating and gratifying due to the lack of authenticity and established guidelines. It was gratifying in the sense that law itself is the oldest and evolutionary force that has laid the foundations of order co-existence, and society from its simplest form to its newest form. So, adjudication, if further practised, examined and evaluated can be the finest form of law that can replace most of the torturous and violent convictions and treatments enacted in today’s criminal justice and administrative justice systems.
To establish the right and just solutions for different transactions of life, this book offers a comprehensive and complete guide regarding international arbitration, from addressing its history to the right practices for arbitration, its formation, procedures, decisions, and conflicts. At a broader level, it encapsulates the necessary procedures to be adopted when dealing with conciliation processes with the involvement of international and interstate entities. The reader could read separate and dedicated chapters regarding regulations of the Permanent Court of Arbitration relating to disputes relating to natural resources or the environment, and even outer space activities. Furthermore, they will find a concerning implementation of arbitration decisions by the arbitration court of ICJ in the Hague. Also, it offers a read about state immunity in international investment disputes. Therefore, it can be called a treasure hunt, for complex legal phenomena and a solution guide to answer legal issues of arbitration and conciliation. This reflects my goal of reimagining administrative laws.
