God – the Mighty and Sublime – has created man and made the earth a place of residence for him and enjoyment for a while, and sent down books to him, and sent messengers to him, so that he may worship God with insight. And some of them benefit from each other, from buying or selling or other types of dealings, whether commercial or social, in harmony and familiarity, so that a person can fulfill his needs and acquire from others the best that he has. Then, since this dealing may result in a difference between the two parties, with each of them claiming that he is the owner of the right, there must be a side that decides that right and clarifies its owner, so people turned to people to seek judgment from them, and the dispute arising because of the difference was settled. Time has passed, and it has made its bases on which it is based, judicial authorities, which are called in today’s world (the judicial authority) to which the litigants plead, in a customary way, and judge by what it deems right, and the arbitrator is binding on both parties, and the state implements it in the face of the one who has the first right. And with the presence of this judicial authority, the litigants may refer to persons, other than the judicial authority, who are agreed upon to be appointed by the litigants, and their judgment is binding, which is called (arbitration). One of the prohibitive expressions is what Dr. Mohsen Shafiq said in explaining what arbitration is. At the beginning of the agreement, in the middle of the procedure, and at the end of the judiciary. The outcome of the arbitration process is the issuance of a conclusive final arbitration award that resolves the legal dispute that the two arbitrators agreed to refer to arbitration. The Qatari arbitration law came to a large extent close to the Egyptian arbitration law and the rules of UNCITRAL. In this book, we explain the provisions of the Qatari Arbitration Law in a detailed manner to bring it closer to the mind of our dear reader, with a comparison with the Egyptian Arbitration Law No. 27 of 1994 AD.
